Three nights ago, a group of young men was picked up by the local police from a bar in Andheri East, Mumbai. The reason given to them for their detainment was that the bar they were drinking at did not have a license to serve alcohol. The youths were released from police custody only the next morning, after people in high places intervened. An account of the night by Arun S Ravi:
Everyone was above the age of 21.
Date – Thursday, 17th February, 2011
People in the bar at the time of arrest – 23
Time of arrest – 11: 15 pm
Type of people at the bar –
A group of boys celebrating their friend Siddharth’s birthday including a non-drinking 21year old whose hand was in a sling because of a cricket injury.
2 casual drinkers.
A boy named Brenden celebrating the fact that he was to fly to Dubai on the 18th , with his friends.
A man named Sarfaraz who doesn’t even drink. Neither does his friend who was with him. Etc.
Ashwin and I went for band practice at Freedom Jam Room and decided to go to LP for food and a couple of drinks post practice. We met Keegan Pereira and Avil D’Souza at the bar and were engaged in conversation till 11pm when a cop truck and 2 cop cars arrived outside the bar. The police barred anyone from leaving the bar and forced people to stay inside while they performed their “rounds.” It is to be noted that the cops have been seen performing these rounds on other occasions as well while we’ve been there and it was all fun and games before, but not so much this time.
Timeline with details-
11:00pm – An empty cop van pulls up outside the bar with some 20 odd cops in another van behind it. There’s a police car with its siren lights on outside, and police officers in it. These officers enter the bar, and exit the bar. They enter again and assault a waiter who tries to make a phone call and yell Hindi curse words at him. People start talking when this happens and a cop yells (at the top of his voice) at all of us telling us to shut up. 2-3 other cops dressed in casuals very rudely ask us for our details without telling us why this is happening to anyone and asking for our cooperation. The details included name, age, religion, phone number, father’s name and full postal address.

11:30pm – All of us (23) are forced to enter a police van that seats 10. The interiors of the bus are filled with cop uniforms hung on railings near the windows, riot shields, chairs and the whole bus just generally fucking stunk. We still aren’t told why this is happening to us and are asked for our cooperation, but very rudely. The way you would ask murderers to cooperate. People start asking why this is happening but we’re told to wait for 15 minutes and they’ll let us go. They said we would be taken to a hospital for a medical checkup. They didn’t tell us what for. We were brought to Cooper Hospital in Juhu in a police van, paraded around the city like criminals and escorted by other police vans. We had 1 armed guard with an assault rifle and a Kevlar vest in our bus and 2 other cops.
12:00pm – We arrive at the hospital and are escorted by armed policemen to the MI room where the medical checkup was to happen. They called out our names one by one and the following is how the checkup took place –
Doctor – Is there any problem with you?
Person – No.
Doctor – Lift up your shirt…. Ok. Now turn around.
This comprehensive checkup was done for all 23 of us and we were forced back into the police van and were escorted to the Andheri East Police Station.
"Celebrating" their friend's birthday in police custody.
1:00am – Upon arriving at the station, all of us are forced into a room and are locked inside it. The room had railings we could look through and communicate with the pigs. We didn’t have any food or water and then we realized that we still had Siddharth’s birthday cake. All of us sang for his birthday and shared his cake behind bars and got to know each other better. The police officer outside, very rudely, told us to shut up. One of the boys yelled back at him. He got up and had his guards open the door so they could give him “special treatment” in some other room. When they came to take him away, all of us pushed him back into the crowd and didn’t allow the officers to touch him. They withdrew and locked the doors. 2 cops then entered with forms that said ARREST/COURT SURRENDER FORM (Avil D’Souza stole a copy of this form) and they forced us to fill these forms as “standard procedure.” None of us said we would and they left the room.
1:45am – People start calling their friends and relatives who could get us out of this mess. The 3 star police officer enters and tells us to shut up. When asked why we were brought here and treated like absolute shit, his response was “You were drinking in a bar without a liquor permit.”

“Why the fuck aren’t the bar owners in this room then?” asked someone to which we never got a clean response, ever.
A relative of one of the boys happened to be the leader of the Youth Congress in south Mumbai . He tried to talk the cops out of it by asking them how we were supposed to know about liquor permit. He said “I have been to LP for over 30 years and this has never happened before.” But the cops didn’t budge. They didn’t even do a breath analyzer test or any concrete medical test to even have any evidence to put us behind bars. It turned out that the lifting-shirt-up fiasco was the check for signs of assault. They said they would have to have us fill the forms only then they could let us go. They also wanted to use us as an example and have us testify in court that the bar we were at didn’t have a liquor permit to scare all the other bars doing the same thing to apply for one, or shut down. They wanted us, desperately to do this, hence we were forced to fill the forms, even if it meant detaining us without any grounds for arrest. When asked why we were locked up the police officer said “They are not locked up, they are in a room.”
4:00am – Tired, everyone finally agrees to fill the forms because we’ve been confined in this shady room with barely any water, no food, and no permission to go to the toilet. Manoj Vishwakarma has a 1 year old boy and his wife waiting for him at home without any clue about what’s really going on. Everyone else had similar stories and it got to a point where we were desperate to leave. We decided to fill up the forms but not sign them. The 2 constables reappeared with the forms and everyone filled them. We were then loaded back into the police truck to be taken back to Cooper hospital in Juhu for a breath-analyzer test.
DEAD DRUNK: The Wasted Constable
5:30am – We reach Cooper hospital after the forms are filled. Again, we are taken there with an escort. Passersby stare as we go by them and everyone looks at us like we’re some criminals. The same armed guard is in the van with 2 constables. The van was stopped outside cooper hospital. Some 40 police constables were outside the hospital waiting for us. The bus stopped at the drive in and we were asked to remain inside the vehicle. After a few minutes we realized we can’t be treated this way. We asked them nicely if we could stand outside the bus, without running away. Just a request. Then a cop yelled at us and told us to be inside. (All the cops were armed with lathis). All of us yelled back at them and took a stand. Everyone would get out of this vehicle NOW. We decided that if they had to hit us, they could do it, but we weren’t fucking staying inside the bus. All of us rushed out of the bus yelling. Everyone was insulting the police, calling them names. Shouting at them at their face. A very emotional Suhail yelled (in Hindi) “TELL US WHY HAVE YOU DETAINED US YOU FUCKING MOTHERFUCKERS!!!! IT’S BEEN 6 FUCKING HOURS!!!! WHAT THE FUCK HAVE YOU DONE!!! WHAT THE FUCK ARE YOU DOING WITH US YOU MOTHERFUCKING PIECES OF FUCKING SHIT!!! WE HAVEN’T EATEN WE HAVEN’T HAD ANYTHING TO DRINK !!! OUR FAMILIES ARE WONDERING WHERE WE ARE!!!! WHAT THE FUCK DO WE TELL THEM!!!!!!!” The cops charged to beat him up but we pushed them away and pulled back Suhail and held him back. He was still yelling. Others started yelling too. Then Ashwin Dutt pointed out a drunk constable standing on the cops side. ALL attention went to him. We pulled him to the forefront and took photographs of him. “WE ARE CITIZENS, YOU ARE PUBLIC SERVANTS AND YOU’RE DRINKING ON THE JOB AND ARRESTING US!!!???” someone yelled. “ALL THE COPS SHOULD BE PUT BEHIND BARS AND WE SHOULD BE LET GO!!!.” The drunk constable tries to sneak away but Avil and Ashwin run after him and grab him by his collar and bring him back.

6:15am – We are forced again to do the medical test. But we took a stand and said that the wasted constable should be check first. On insisting, the same 3 star officer said “You don’t need to check him, He’s got a family.” Hearing this everyone broke out into anger, yelling at the police for assuming all of us are street orphans! We finally did and completed the test. All of us were loaded back into the armed van and taken back to the police station at Andheri East.
7:30am – The police call it as a bad joke and let us go after they verify whether or not we’ve filled the “Arrest” forms.
PS – Just found out that the name of the police officer is Sr. Police Inspector Bhalerao.

Also, I hate to be a preaching asshole, but all of you who are incensed at the police because of this incident, think of how much worse the poor and the disenfranchised among our citizens have it, those that don’t have camera phones, or lawyers, and don’t live in a big city where Mid Day will run after you to print this story. This is just a relatively tame example of the police’s brazen disrespect for the rule of law and for the rights of citizens which happened to be directed at the wrong people (people society cares about). Much, much worse happens on a daily basis. So get angrt at this, which you SHOULD totally do. But also get angry when the same thing happens to people who aren’t in your social networking circle and your bar hopping scenes.
LP is my favorite joint too. I’ve been going there for the past 5 years now. This is stupid. Nothing shady or illegal happens at the bar… the service is good, the food is good, the booze is cheap, and the crowd is well-behaved. Even when we go partying somewhere, we usually come here to close for the night and have their famous dal khichdi.
I feel that the police were sent out on a raid to arrest bar girls and dancers at the orchestra bars around LP, and since they couldn’t find any to arrest (or were prolly bribed by the owners) they turned on the the men simply consuming alcohol in a place we all thought was legal, so that they’ll have at least something to report/deliver to their superiors.
By the way, if I am not mistaken, Mumbai (or for that fact Maharashtra) still has an archaic law that says that you need a special license just to consume alcohol! I have seen such a license with one of my friends too. If you try to pressure the cops about injustice etc, they usually protect themselves by using this old law as their weapon!!!
Please mail this to the top cops, the so called officers and harass them by asking what action they have taken against the drunken cop and all others. Do even cc this to all major news papers.

Also tough luck if you’re below the age of 25, you’re not within the legal limit yet

While your treatment by the cops is reprehensible, you guys can’t really do anything about this for two reasons:
1. It’s not legal to drink in Maharashtra under the age of 25
2. Even if you are above 25, you need a permit to drink since Maharashtra is technically under prohibition.
File an FIR against the Cops in the same police station. The cops may resist and not easily file the case. Therefore, take some friends and family along; ideally some media people too. Once an FIR is filed, action will have to be taken. Even if they go unpunished, this negative record stays with the Cop in times of evaluation and promotions….

Hats off to the boys for standing their ground…. The cops should be reminded that they work for the citizens and not the other way around….. Its a shame that the taxpayers are paying for cops that are drunk on duty, rapists etc…. Senior inspector Bhalerao should either be suspended our asked to resign…. If the law can permit holding 20 innocent people overnight without a charge…then it should prosecute the officer who was drink on duty and any superior of his who was on duty with him…. Now is the time for the youth political leaders to make some noise about this and get these boys some justice….After all …no 1 should be punished for simply trying to have a good time …. Keep up the god work boys… This story has generated a lot of buzz and hopefully the senior inspector & the drunk constable are prosecuted …. We should be the ones making an example out of them! so that every policeman harassing innocent people (which happens all the time) will remember this incident and it’s outcome.
Kudos to you guys for standing up to those corrupt cops. I got yelled and glared at for questioning a traffic cop (near Santa Cruz station) when he stopped the auto rickshaw I was travelling in and demanded bribe from the poor chap. The rickshaw guy was probably at fault too (expired driver’s licence or some such), but what enraged me was that not only did the cop demand bribe from him, he also had the audacity to slap the auto driver AFTER snatching his day’s worth of earnings.
I think Mumbai Mirror has done a fantastic job of their ‘No-Hoardings’ campaign. Their next project should be to bring these corrupt cops to book! I’m sure all of Mumbai will participate whole-heartedly!
Errmm.. drinking at 25 does put you, strictly speaking, in violation of the law, but its a very very stupid law. And this is OUTRAGEOUS. Mumbai Police has anyway been notorious for a while now, but even they outclass themselves with this activity.

It is been told by the cops they were ordered by the Zone DCP to arrest the customers of Laxmi Palace.
Now my question is to the Zone DCP, how would these cops know if all the customers were drinking, there were some who were there for dinner.
The arrest was done at approx 11.30 pm, and the medicals were done at 6.30 am next day morning. Why were the innocent people detained for 7 hrs. Why didn’t they come with breathalysers and get this resolved on the spot at least the people who were there for dinner could have gone home same night.
If I sit an autorickshaw and if the driver doesn’t have a driving license do these cops arrest the passenger or the autoricksaw driver ?

The police need better remuneration. But above all we need to bring back the old Bombay Police and havaldars in blue uniforms and half chuddis. They were thin and wiry and could run. Bombay Police, once the pride of the country and rated on par with Scotland Yard, was fucked when it turned into Maharashtra Police. These guys who come from the outback neither have any investigative knowledge nor the mentality needed to be urban policemen. They are laid back and have money on their minds all the time.

But really. Those blue-uniformed guys being local Bombaywalas, knew the city’s crime pattern. They were reliable aides to their bosses and were good at intelligence-gathering, very often making the job of their senior officer extremely easy.
The Bombay Traffic Police havaldars at one time were the best in the country. I still think they are even now. Many of them are non-corrupt and good at their job and they command respect, but they simply cannot cope with the ever increasing traffic in the current infrastructure and their bosses’ stupid whims.
There is the occasional rogue, but I’ve been let off many times by reasonable and understanding traffic constables without having handed them any monetary incentive.

Mumbai police are the worst bunch of hypocritical humans I’ve ever seen anywhere in the world. It’s time the press did a public service on put the spotlight on then. The real reason for all the chaos is most likely to do with this particular bar refusing to give corruption money for what is a perfectly legal activity. Who suffers, innocent youth. The power from the police really needs to be taken back in the hands of the public. These days even Rickshaw drivers refuse to drive to the airport because the corrupt police will take away half their fare. Every time a law is passed in this land, the police rejoice as it’s an excuse for greater exploitation! As an NRI I’ve seen this country sinking, from it’s liberal democratic highs to the corrupt country its now become. Mumbai was special, now I wouldn’t make the same decision to invest here in my business again. Why there is no process by the government to check if the cops on night duty are drunk, if they can check a common man, they should also do check on the government servants first.

The governement instead of pocketing the taxes spent on cops, need to pay them a LOT LOT LOT more money in their salary, enough that they can survive and live on their salaries and not resort to bribes. Then fire every Pandu who is useless and bent (which would be 65-70% of the force) and hire new policemen, who have completed school at the least (18million official population in bbay, im sure we can find an entire educated new force from that population). Have a stringent testing method of their knowledge and adherence to the state laws.
Along with the alcohol laws, there needs to be clarity on the police brutality laws. I thinks its highly commendable that you could stand together and prevent them from brutalising your friends. Where in the law does it say that the cop has the right to slap anyone who annoys them. Isn’t that fucking assault and battery? Shouldnt they be only allowed to use force in self defence or during obstruction of justice with the aim to prevent and disable further attack but not to damage the person brutally? Ofcourse how could they disable an opponent with those massive pot bellies, so it takes 2-3 of them, lathis and brutality.

Easily said, but the question is: do educated, honest and conscientious people (from the population of 18 million) want to join the police force (read cesspool)…? It’s the same story with the Armed Forces (though elite)- nobody wants to join because of the paltry wages. And we’re seeing corruption seeping into what is arguably the most dependable institution in the country.

This is a fundamental flaw which the country needs to realise and relates to a standard of living. If you cannot provide the protectors of your public a decent standard of living which is provided to them vis-a-vis the salary that they are receiving, then the human instincts of greed and more importantly (survival and well over-survival) kick in. Make being a police an extremely well paid and highly controlled profession and we may just get some brilliant honest cops out there. Ofcourse there will still be some corrupt ones, but you could convert the % from an over 50% to hopefully under 50% corrupt force.
The next issue is that “standard of living” is a very subjective term.

the “government” i.e. the politicians- they’ll never allow the police to be well paid (a lot of cops are on politicians’ payrolls, so the politicians can manipulate them). This is one of the main points that constitute police reforms, that the police be separated from the polity, but will that ever (be allowed to) happen? And what are the ramifications of an independent, fearless and honest police force? It will put and end to all the nonsensical political gamut. It will mean, no more political interference in matters handled by the police.

Legally, cops have no right 2 enter a bar premises..its da job of excise department…there r more serious issue to tackle with in city of mumbai…but these guys r more concern in harassing a common people (i.e TAX PAYERS) who r treated like murderers/criminals 4 da law which was amended in 1949….Maharastra is da only state where person requires permit 2 consume or posses a liquor….Maybe tommorrow we will be asked permit 4 consuming food and water also..this is sheer injustice in our free country…!!!
